1. Governing Law (Texas Jurisdiction)

These terms and any separate agreements whereby we provide you with services and/or products shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal disputes arising from this website will be handled exclusively in the state or federal courts located in Denton County, Texas.

2. Products, Inaccuracies, and Pricing

• Handmade Variations: Because our jewelry is uniquely handcrafted, slight variations in bead alignment, color, texture, and natural gemstone patterns are to be expected and are not considered product defects.

• Errors and Omissions: We do our absolute best to ensure our site is perfectly accurate. However, we reserve the right to correct any typographical errors, inaccuracies, or omissions (including pricing, product descriptions, or shipping times) and to cancel orders if any information on the site is inaccurate at any time without prior notice—even after you have submitted your order.

• Price Changes: Prices for our products are subject to change without notice. Price changes will never apply retroactively to an order that has already been placed and processed.

3. Payment and Security

All payments are processed securely through our automated third-party e-commerce gateways (Stripe/Square). We never store or view your full credit card information. By providing a payment method, you represent that you are authorized to use that method and authorize us to charge the full order amount.

4. Shipping Risk and Delivery

• Fulfillment: Orders are processed and handed over to our shipping carriers within our standard processing windows.

• Transfer of Risk: Once a package is scanned and accepted by the carrier (USPS, UPS, etc.), the legal risk of loss, damage, or delivery delay shifts to the carrier and the customer. We are not responsible for packages marked "Delivered" by the carrier that are lost or stolen from porches or mailboxes.

• Customs and Duties: For any international orders, the buyer is solely responsible for any customs fees, import duties, or local taxes incurred upon entry.

5. Returns, Custom Orders, and Final Sales

• Standard Returns: We accept returns on unworn, unaltered items in their original packaging within 14 days of delivery. Return shipping costs are the responsibility of the customer.

• Custom Designs: Any custom-sized pieces, personalized jewelry, or items explicitly marked "Final Sale" cannot be returned or exchanged.

• Damaged Items: If a piece arrives damaged due to shipping transit, you must contact us within 48 hours of delivery with photographic proof so we can process a replacement or repair.

6. Intellectual Property

All content included on this site, including but not limited to jewelry designs, unique collection names, product photographs, branding materials, logos, and written text—is the exclusive intellectual property of NiftyBeadz.Co. You are strictly prohibited from copying, reproducing, or commercially exploiting our designs or imagery without express written permission.

7. Limitation of Liability

To the maximum extent permitted by Texas law, NiftyBeadz.Co shall not be liable for any indirect, incidental, punitive, or consequential damage resulting from the use of our website or the wearing of our products. This includes, but is not limited to, minor skin reactions to metal alloys or components, structural damage caused by pulling or improper care, or choking hazards from small beads (our items are intended strictly for adult use).
